These Terms and Conditions ("Terms") govern access to and use of GetEstateOS (the "Service"), operated by GetEstateOS ("we", "us", "our"). By creating an account, browsing the marketplace, or otherwise using the Service, you agree to be bound by these Terms. If you are registering on behalf of an agency, you confirm you have authority to bind that agency to these Terms.
GetEstateOS is a multi-tenant real estate platform providing a public property marketplace, an AI chat assistant, a lead/CRM pipeline, appointment and open-house scheduling, and related analytics and integrations, licensed to real estate agencies under subscription plans (Basic, Advanced, Enterprise).
You must provide accurate, current information when registering an account and keep your login credentials confidential — you are responsible for all activity that occurs under your account. An agency ("tenant") account is created by an Agency Owner, who may then invite Agents to join using the agency's company code. We may suspend or terminate an account that provides false information or is used in violation of these Terms.
Agency accounts require an active subscription on one of our published license plans. A new agency account remains in a pending state until its first payment is confirmed, either by instant card payment or by paying an emailed invoice; the account is activated automatically once payment is verified. Fees are billed as described at checkout and on our pricing page, and are non-refundable except where required by law. If a subscription lapses or is not renewed, access to the authenticated application is suspended until it is renewed, though publicly visible listings already submitted to the marketplace may remain unaffected at our discretion.
You agree not to: submit false, misleading, or fraudulent property listings; use the Service to harvest data about other users or agencies; attempt to bypass tenant data isolation, rate limits, or access controls; upload malicious code; use the AI assistant or chatbot widget for any unlawful purpose; or use the Service in a way that infringes the rights of others. We may suspend or terminate access for any violation of this section.
Property listings, pricing, and availability are submitted and maintained by the agencies and agents using the Service — we do not independently verify listing accuracy. Agencies are solely responsible for the accuracy, legality, and completeness of the content they publish. Buyers should confirm listing details directly with the responsible agency before making any decision.
The Service, including its software, design, and branding, is owned by us or our licensors and is protected by applicable intellectual property laws. You retain ownership of the content you submit (such as listing descriptions and photos), and grant us a license to host, display, and distribute it as necessary to operate the Service, including showing your listings in the cross-tenant marketplace.
The Service can connect to third-party providers you configure — including WhatsApp Business, SMS, email, and calendar providers, and payment processing via Stripe. Your use of those providers is subject to their own terms; we are not responsible for their availability or conduct, and connecting them is optional and configured per agency.
The Service is provided "as is" and "as available" without warranties of any kind, express or implied, including fitness for a particular purpose or non-infringement. We do not guarantee the Service will be uninterrupted, error-free, or that AI-generated recommendations or responses will always be accurate — they are provided for informational assistance only and do not constitute professional real estate, legal, or financial advice.
To the maximum extent permitted by law, we will not be liable for any indirect, incidental, special, or consequential damages arising from your use of the Service, including loss of profits, data, or business opportunity, even if advised of the possibility of such damages. Our total liability for any claim relating to the Service is limited to the amount you paid us in the twelve months preceding the claim.
You may stop using the Service and close your account at any time. We may suspend or terminate an account for breach of these Terms, non-payment, or if required by law. On termination, your right to access the Service ends, though certain provisions (including §§6, 8, 9) survive termination.
These Terms are governed by the laws applicable in the jurisdiction where GetEstateOS operates, without regard to conflict-of-law principles, and without prejudice to any mandatory consumer protections you're entitled to under the law of your own country of residence (including the UK, Canada, and USA, which are within our operating and compliance scope).
We may update these Terms from time to time. We will update the "Last updated" date above when we do, and for material changes we will provide additional notice. Continued use of the Service after changes take effect constitutes acceptance of the revised Terms.
